Terms of Service

These Terms of Service ("Terms") govern your use of ARIG Enterprise software and services provided by ThalosForge Inc. ("Company," "we," "us"). By using our services, you agree to these Terms.
1. Acceptance of Terms
By accessing or using ARIG Enterprise, you agree to be bound by these Terms. If you are using the service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of Service
ARIG Enterprise is a runtime intelligence and process supervision platform that provides:
- Process monitoring and health checking
- Anomaly detection and alerting
- SLO tracking and error budgets
- Automated remediation
- Cost attribution
- Chaos engineering capabilities
3. Account Registration
3.1 Account Creation
To use ARIG Enterprise, you must create an account with accurate and complete information. You are responsible for maintaining the security of your account credentials.
3.2 Account Responsibilities
- You are responsible for all activity under your account
- You must notify us immediately of unauthorized access
- You may not share accounts or license keys
4. License and Usage
4.1 License Grant
Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable license to use ARIG Enterprise according to your subscription tier:
- Starter: Up to 10 processes, single environment
- Professional: Up to 100 processes, multiple environments
- Enterprise: Unlimited processes, custom terms
4.2 Restrictions
You may NOT:
- Sublicense, sell, or redistribute the software
- Reverse engineer, decompile, or disassemble the software
- Remove proprietary notices or labels
- Use the software to provide competing services
- Exceed your licensed process limits
- Use the software for illegal purposes
5. Payment Terms
5.1 Fees
- Fees are charged monthly or annually in advance
- All fees are non-refundable except as required by law
- We may change prices with 30 days notice
5.2 Billing
- Payment is due upon invoice
- Late payments accrue interest at 1.5% per month
- We may suspend service for non-payment after 15 days
6. Intellectual Property
ARIG Enterprise and all related intellectual property remain the exclusive property of ThalosForge Inc. These Terms do not grant you any ownership rights.
Your Data: You retain all rights to data you process through ARIG Enterprise. We claim no ownership of your data.
7. Data and Privacy
Our collection and use of data is governed by our Privacy Policy. By using our services, you consent to our data practices.
For self-hosted deployments, your monitoring data remains in your infrastructure and is not transmitted to us.
8. Service Level Agreement
Enterprise customers receive SLA guarantees as specified in their contract. For other tiers:
- We target 99.9% uptime for cloud-hosted components
- No SLA guarantees for Starter or Professional tiers
- Planned maintenance will be announced 48 hours in advance
9. Support
- Starter: Community support via documentation and forums
- Professional: Email support with 24-hour response time
- Enterprise: Dedicated support with 4-hour response time
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- OUR TOTAL LIABILITY IS LIMITED TO THE FEES PAID IN THE 12 MONTHS PRECEDING THE CLAIM
- WE ARE NOT LIABLE FOR LOSS OF DATA, PROFITS, OR BUSINESS INTERRUPTION
12. Indemnification
You agree to indemnify and hold harmless ThalosForge Inc. from claims arising from:
- Your use of the service
- Your violation of these Terms
- Your violation of any third-party rights
13. Termination
13.1 Termination by You
You may terminate your account at any time. No refunds for partial months.
13.2 Termination by Us
We may terminate or suspend your account for:
- Violation of these Terms
- Non-payment
- Illegal activity
- Extended inactivity (12+ months)
13.3 Effect of Termination
- All license rights terminate immediately
- You must cease using the software
- You may export your data for 30 days post-termination
14. Dispute Resolution
14.1 Informal Resolution
Before filing a claim, you agree to attempt informal resolution by contacting [email protected].
14.2 Arbitration
Any disputes not resolved informally shall be resolved by binding arbitration under the rules of the American Arbitration Association. Arbitration will take place in Delaware, USA.
14.3 Class Action Waiver
You agree to resolve disputes only on an individual basis and waive participation in class actions.
15. Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.
16. Changes to Terms
We may modify these Terms at any time. We will provide notice of material changes via email or prominent notice. Continued use after changes constitutes acceptance.
17. General Provisions
- Entire Agreement: These Terms constitute the entire agreement
- Severability: Invalid provisions will be modified to minimum extent necessary
- No Waiver: Failure to enforce a provision is not a waiver
- Assignment: You may not assign these Terms without consent
